Increasing Trial Pressure
Roundup trial verdicts against Monsanto (the manufacturer of Roundup) are important because the verdicts put pressure on Monsanto to settle outstanding Roundup cases. In 2023, Monsanto was a defendant in 9 different trials that reached verdicts. Monsanto won three of the trials meaning that the injured plaintiff received no compensation for their injury. However, Monsanto lost six trials. The aggregate of judgments rendered against Monsanto in those 6 trials was over $4 billion. At one of those trials, one injured plaintiff won a verdict against Monsanto for $2.25 billion. Many defendants facing a large number of similar cases choose to settle all or most of the outstanding cases against them. Accordingly, Monsanto may decide to settle the remaining cases to avoid additional substantial verdicts. Please note that it is unlikely that you will obtain a trial where you will have the opportunity to win a large judgment. Cases that will foreseeably obtain a trial setting have been filed for a long time.
These large verdicts often signal that a settlement might be forthcoming. If a settlement is forthcoming, it is prudent to file your Roundup claim as soon as possible. And although there might be a path to compensation after a settlement is reached with Monsanto, there are no guarantees. Accordingly, Jacobson Injury Lawyers advises that anyone with a Roundup claim pursue their claim immediately. Jacobson Injury Lawyers are standing by and are available to answer all of your questions and file your Roundup claim on your behalf. There is no upfront payment required to file your Roundup claim – you only pay fees and costs when you win or settle your case.
About Roundup
Roundup is a widely used brand of herbicide that is designed to kill weeds and grasses that compete with agricultural crops, as well as plants in residential, commercial, and public spaces. The active ingredient in Roundup is glyphosate, which was discovered to be an effective herbicide by a Monsanto chemist in 1970.
Roundup works through its active ingredient, glyphosate, which is a broad-spectrum systemic herbicide. Plants absorb glyphosate through their leaves and, to a lesser extent, their stems and roots. Because it is systemic, glyphosate spreads throughout the plant. Glyphosate then disrupts the plant’s ability to synthesize the essential amino acids. This disruption halts protein synthesis, ultimately leading to the death of the plant. Glyphosate is very effective at killing unwanted plants. However, Roundup is also very dangerous.
Key Roundup Ingredient Deemed Carcinogenic
In 2015, the IARC, part of the World Health Organization (WHO), classified glyphosate as “probably carcinogenic to humans.” This classification was based on limited evidence of cancer in humans (from real-world exposures that actually occurred) and sufficient evidence of cancer in experimental animals (from studies on laboratory animals).
Roundup users obtain harmful contact with the product during mixing, application and handling of the product. Roundup enters into the body through skin contact, inhalation, eye contact and in rare cases through ingestion. The more exposure to Roundup someone has, the more likely that person is to contract a Roundup related injury.
Roundup As Carcinogen Spurred Litigation
Many consumer protection and public health advocates strongly suspected that Roundup was a carcinogen that could cause serious and deadly cancers. However, after the World Health Organization (WHO) classified glyphosate as “probably carcinogenic to humans” the controversy over Roundup increased. Thousands of lawsuits were filed in the United States by individuals alleging that long-term exposure to Roundup caused them harm. These lawsuits claimed that Monsanto failed to warn users about the risk associated with glyphosate.
Several cases went to trial, serving as bellwether trials to gauge the reaction of juries to the evidence presented and potentially guide the resolution of thousands of similar claims. Notably, these early trials resulted in substantial verdicts in favor of the plaintiffs in 2018 and 2019. Facing a growing number of lawsuits, Bayer (the corporate parent of Monsanto) announced in June 2020 that it would pay more than $10 billion to settle tens of thousands of existing Roundup claims in the United States. However, Monsanto did not settle all of the outstanding cases and some plaintiffs decided to pursue trials. Monsanto has continued to defend the safety of Roundup and glyphosate, appealing several of the adverse verdicts and arguing that regulatory agencies worldwide have concluded that glyphosate is safe for use as directed.
