About Paragard

The Paragard IUD (Intrauterine Device) is a long-term, reversible form of birth control. ParaGard contains a small amount of natural copper. The copper is wrapped around the plastic base of the IUD. The copper is toxic to sperm, which helps to prevent fertilization and pregnancy.

One of the main advantages of ParaGard is its long duration of effectiveness. It can provide birth control for up to 10 years after insertion. And since ParaGard doesn’t contain hormones, it’s often chosen by women who prefer or need to avoid hormonal birth control methods due to side effects or other medical reasons.

Paragard Injury

Paragard is inserted into the uterus by a healthcare provider. The process is usually quick. Removal is also usually completed by a healthcare professional. However, when Paragard is removed, the product can fracture and in many instances, fragments migrate to other parts of the body causing serious harm. Injuries from a fractured Paragard IUDs include abdominal pain, vaginal bleeding, infection and infertility.

Treating Paragard Injuries

The primary treatment for a Paragard IUD that fractured during removal is the removal of the resulting IUD fragments from the uterus. The approach to removal of the Paragard factures depends on where the fragments are located. If fragments are within the uterine cavity and reachable, they can often be removed with standard IUD removal techniques. However, if fragments have migrated outside the uterus or are embedded in the uterine wall, a more complex surgical procedure may be necessary. These surgical procedures consist of either opening the uterine cavity and removing the fractured Paragard IUD pieces or performing a hysterectomy. Given that surgical interventions required to remove the Paragard IUD fragments are invasive, some women face serious and irreversible injuries.

Who is Responsible and Why?

The defendants in the large mass action are the two companies that owned and manufactured Paragard. These two companies are Teva Pharmaceuticals USA, Inc. (Teva) and the Cooper Companies, Inc. (Cooper). Teva sold Paragard to Cooper in 2017. The allegations against both defendants are substantially similar. The lawsuit claims Paragaurd was defective, the manufacturers knew or should have known that Paragraud was defective and that the manufacturers failed to warn prescribing doctors and women about the potential harm.

Over 2,000 women filed lawsuits against Teva and Copper claiming injury from Paragard. Since all of these claims are against the same defendants and regard a Paragard personal injury, the courts consolidate the lawsuits into a mass action in what is termed multidistrict litigation (also known as a MDL). The MDL is located in the U.S. District Court for the Northern District of Georgia. The MDL will hold bellwether trials in late 2024 or 2025. Bellwether trials are a common practice in MDLs, serving as test cases that help both parties gauge how juries might respond to the evidence and testimony that will be presented throughout the litigation. The outcomes of these bellwether trials are often used to guide settlement negotiations in remaining cases.

Who Qualifies for the Lawsuit

Jacobson Injury Lawyers is currently accepting clients that (1) used Paragard IUD; (2) the Paragard IUD broke; (3) the Paragard IUD was removed no more than 10 years after implantation and (4) the Paragard IUD caused injury. If you or a loved one have been injured by Paragard, contact the Jacobson Injury Lawyers today to talk to a licensed attorney with specific knowledge about the Paragard litigation. A consultation with an attorney from Jacobson Injury Lawyers is always free and you pay nothing in fees or expenses until you recover for your Paragard injury.

Your Doctor Is Not the Target of The Lawsuit

Paragard is usually inserted by your gynecologist but may also be inserted by a family practice physician, nurse practitioner or physician assistant. Many of these physicians and staff members have close relationships with their patients. Accordingly, many people injured by Paragard express concern that a lawsuit to obtain compensation for damages from Paragard will involve a lawsuit against their trusted doctor or medical professional. Jacobson Injury Lawyers is only accepting cases against Teva and Cooper and will not file a case against your doctor or medical professional. After all, the medical provider would presumably not have recommended Paragard if they were properly warned that Paragard often broke and caused serious injuries.
